I get this question a lot. People often think child support is a fixed number, like once it's set, it's locked in forever. But the truth is, child support can absolutely change depending on what's going on in your life or your child's life. Whether you've lost a job, income has increased, or your child's needs have changed, the system does have ways to adjust support amounts. Here's how it works: child support is typically based on a formula, one that includes parenting time, health care, child care costs, and other things. But that formula isn't frozen in time. It changes based on current circumstances, so if life changes, the calculation might change. For example, if you lost a job or if parenting time has changed, you can often file for a modification. And this would also go if something has changed with your co parent, if they've had a change in their circumstances. So thinking about, like, job losses, increases in income, if there's new medical expenses, changes in parenting time or custody time, those are the types of circumstances that often lead to a need to review or modify child support. But here's something that people often don't think about. If you are struggling to pay child support or feel as if a change in circumstances has resulted in you needing more support, you don't want to wait too long to ask for the modification. Often times child support modifications are not retroactive, so you want to request that change or seek a modification as soon as the circumstances have changed. So if there is a need for more support, if you're struggling to pay the support, or if circumstances have changed, you want to bring that to your attorney or bring it to the court's attention, or try to work out changes with your co parent if possible. So no child support is not set in stone, it is meant to reflect what's fair based on the real needs and the real circumstances at that time. So if life changes, child support may change. At PartWise, we help you to understand how to navigate support, how to calculate it at the beginning, and what to do for modifications and any changes that come up.
